Before buying a real estate and before using a real estate as security, we always recommend conducting a detailed analysis of ownership relations (so-called due diligence). The land registers sometimes are not in line with the actual state, from which certain risks may arise. For example, it is possible that (by law) an owner of a real estate is a person who is not registered in the land registry. Furthermore, a right (right of lien, right of residence, easement, etc.) might have been deleted without authorization, which cannot be seen by gaining insight just in the current and historical excerpt from the land register; this can be determined by analysing the documents contained in the land register. Such situations can even lead to the loss of the ownership right of the new owner, so the mentioned analysis is very useful since it provides a higher level of legal safety.
